The netTrav Best Rate Guarantee Terms and Conditions

A. THE netTRAV BEST RATE GUARANTEE

1. The netTrav Best Rate Guarantee ("Best Rate Guarantee") applies to customers who have booked travel on NetTrav.com ("netTrav") on or after January 07, 2008.


2. If you find an Eligible Lower Rate within twenty four (24) hours of any travel purchase you have booked on netTrav:
   
   
   1. we will do our very best to revise your travel booking with the lower rate and/or
   
   
   2. we will refund the difference between the price you paid through netTrav and the Eligible Lower Rate, and
   
   
   3. we will give you a free 1-year netTrav Membership valued at $99.00. For membership details click here. {link to "Become a Member" page}
   
   

B. TRAVEL PURCHASES COVERED BY THE BEST RATE GUARANTEE

1. The Best Rate Guarantee applies to netTrav bookings for Flights, Hotels, Cars, Cruises, and Vacation Packages.


2. FOR INDIVIDUAL (VS. PACKAGED) TRAVEL PRODUCTS IN THE ABOVE CATEGORIES: the netTrav Best Rate Guarantee and the Eligible Lower Rate apply only to the base cost. Taxes, recovery taxes, fees and/or service fees of standalone Flight, Hotel, Car, and Cruise bookings are NOT considered in determining whether you have found an Eligible Lower Rate. For example, with respect to a standalone Flight booked on netTrav, the Best Rate Guarantee applies only to the base cost of airfare, not including any taxes and fees.


3. FOR ALL TRAVEL ACTIVITIES AND PACKAGES IN THE ABOVE CATEGORIES: taxes and fees ARE included in bookings for Flight + Hotel, Flight + Hotel + Car, Flight + Car, Hotel + Car, and Hotel + Activities packages when determining whether you have found an Eligible Lower Rate.


4. FOR CRUISES: the Best Rate Guarantee applies only to the cost of the cruise, including port charges, which you booked on netTrav. The costs of the following additional cruise items are NOT considered in determining whether you have found an Eligible Lower Rate: onboard amenities, free upgrades, shipboard credits, transfers, hotel stays before or after the cruise, air or land components, gift cards, gift certificates, cash back, discounts, insurance, and other add-ons or optional items.


5. FOR CAR RENTAL ONLY: the Best Rate Guarantee applies only to the cost of the car rental booked on netTrav's main car booking engine as compared with the cost of a car rental available on the main car booking engine of netTrav or another U.S.-based travel booking web site. A rental car price which may be available in association with another travel product (or in the booking path for another product), for example, a car rental price for a rental made in a cruise booking path or in a booking path of any other product shall not be an Eligible Lower Rate.

C. DEFINITION, TERMS & CONDITIONS OF ELIGIBLE LOWER RATE

An Eligible Lower Rate is a lower rate than you paid netTrav within the past 24 hours; that you found on netTrav or another U.S.-based web site; and that meets the Terms and Conditions of this Guarantee, as determined by netTrav in its sole discretion, as follows:

1. EXACT MATCH. An Eligible Lower Rate only applies to identical bookings, as described in these Terms and Conditions. The travel itinerary, including the following, must exactly match the details of your booking on netTrav:
   1. Exact carrier or provider and class of service;
   2. Specific hotel and class of room;
   3. Specific cruise line, ship, and cabin category;
   4. Specific rental car company and vehicle class;
   5. Applicable refund policy or travel insurance;
   6. Specific dates and times of travel or service;
   7. Specific routings, including flight numbers and stopovers; and
   8. All other booking details.


2. LIKE STANDALONE PRODUCT. For standalone travel products purchased on netTrav, an Eligible Lower Rate may apply if the lower rate is for a like standalone product. For example, if you have purchased a standalone Flight on netTrav, a lower-cost flight portion of a Flight + Hotel package is not an Eligible Lower Rate.


3. NO ERRORS. An Eligible Lower Rate cannot include errors.


4. NO AUCTION PRICING. If you have found a lower rate that was determined by any form of bidding including auctions, this is not an Eligible Lower Rate.


5. FULL DISCLOSURE. If you have found a lower rate where any element of the booking details is not visible until after purchase, this does not constitute an Eligible Lower Rate.


6. ADVERTISED TO GENERAL PUBLIC. To be an Eligible Lower Rate, it must be advertised and available to the general public on a U.S.-based web site. This means the following rates do not constitute Eligible Lower Rates:
   1. rewards program rates
   2. group rates
   3. corporate discounts or rates
   4. charter rates
   5. incentives
   6. meeting rates
   7. convention rates
   8. membership rates
   9. coupon codes or prices available only by using a coupon
   10. consolidator or interline prices
   11. any other rates or promotions not offered to the general public.


7. QUOTED & BOOKED ON U.S.-BASED WEBSITE. An Eligible Lower Rate must be visible on the U.S.-based website. If you have found a lower rate where you are required to make a telephone call to get the rate, or if the rate is to be sent to you by email, this is not an Eligible Lower Rate.


8. QUOTED AND BOOKED IN U.S. DOLLARS. An Eligible Lower Rate can only be quoted and booked in U.S. dollars, and without having been converted through currency converters.


9. CRUISE BOOKING PREPAYMENTS. To qualify for our Best Rate Guarantee, you must have already either paid a deposit or paid in full.


10. CONSUMER MUST MEET REQUIREMENTS OF LOWER PRICE. Any special requirements that you have been asked to meet in order to obtain the lower price you are submitting to netTrav for consideration as a possible Eligible Lower Rate must have been met by you. These include, for example, your residency, region, membership, age, and other requirements.

D. WHAT TO DO IF YOU FIND A LOWER RATE

1. To determine if the lower rate you have found per the Terms and Conditions above is an Eligible Lower Rate, complete and submit the online Best Rate Guarantee form to netTrav within twenty-four (24) hours of completing your booking on netTrav. Please no phone calls; this form is the only acceptable method of invoking the Best Rate Guarantee.


2. The lower rate must be available for booking at the time you contact us, as determined by netTrav.


3. In addition to submitting the online Best Rate Guarantee form within 24 hours of your netTrav purchase, also send us a copy of any standalone car or hotel receipt, if applicable, within 30 days after completing the rental or hotel stay. We cannot verify standalone car and non-prepaid hotel bookings until you send us your receipts by fax or postal mail. Screenshots or other so-called evidence of a lower price are not acceptable.

E. WHAT TO EXPECT

1. By submitting a Best Rate Guarantee request, you fully and unconditionally agree that you are bound by these Terms and Conditions and by netTrav's decisions. netTrav will not grant any Best Rate Guarantee request that it believes, in its sole discretion, is the result of an error or bad faith. All requests and documentation are subject to netTrav's verification. netTrav's decisions are final.
2. If we approve your claim, you will receive via email our notification a free 1-Year Subscription to a netTrav Membership valued at $99.00. (Please see Become a Member for information about the benefits, but of course, don't join. We will instruct you how do to so without cost if we approve your claim.) You will also receive email notification of our refund for the price difference as follows:
   1. By check within 30 days after said verification for all except prepaid cruise purchases and prepaid, standalone car and hotel purchases.
   2. By check within 30 days of our verification of the receipts you will have sent us for prepaid standalone car and/or hotel purchases (see D.3. above).
   3. By adjustment to the lower price for cruise booking, if you paid a deposit. Or if you have paid in full, we will either mail the refund to you within two weeks of your cruise date, or we will credit your credit card if that was the original form of payment.

F. OTHER TERMS AND LIMITATIONS

There is a limit of five (5) Best Rate Guarantee claims per customer per calendar year, regardless of the number of accounts you may be using. Only one NetTrav Membership will be allowed per customer per year. If you have more than one approved claim in any calendar year, netTrav will issue within 7-10 days after receiving and approving your documentation, a Promo Code via email good for a One Time Fifty Dollar ($50.00) discount on future travel booked on the netTrav website. (This $50.00 Promo Code is in addition to the adjustment or refund in Item A.2.a. or b. of this Guarantee if your claim is approved.) The Promo Code has no cash value, is not transferable, will not be replaced if lost, can be redeemed only once, and will expire one (1) year from issue date if not redeemed. You may not forward the Promo Code to another person, post it on the Internet or any public forum, or attempt to alter it in any way. Use of the Promo Code is subject to netTrav's User Agreement and Privacy Policy and the Terms of this Guarantee as follows: if you violate these Promo Code Terms, netTrav reserves all rights and remedies available to it, including but not limited to charging your credit card for the Promo Code amount of Fifty Dollars ($50.00); and canceling your reservation without refund to you.

2. netTrav reserves the right in its sole discretion to modify or discontinue the Best Rate Guarantee or to restrict its availability to any person, at any time, for any reason, and without prior notice or liability to you. netTrav's failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision. The terms contained in the netTrav User Agreement are incorporated by reference and made a part of these Terms and Conditions.
